Definitions “Bulq,” “we,” “our,” or “us” refers to Brmja Tech LTD. “Customer” means any individual or business that registers for, subscribes to, or uses Bulq services. “User” means any individual authorized to access or use the platform under a customer account. “Services” means the website, platform, applications, messaging tools, campaigns, automation, billing tools, APIs, ticketing tools, integrations, and related features. “Content” means any messages, templates, files, records, text, campaigns, chatbot flows, contacts, or other materials uploaded, created, transmitted, or processed through the platform. Eligibility You must be legally capable of entering into a binding agreement, and if you use the platform on behalf of a company or organization, you must be authorized to bind that entity. Accounts You are responsible for providing accurate registration information, maintaining the confidentiality of your login credentials, and all activities carried out under your account. Description of Services Bulq provides a multi-tenant SaaS platform that may include WhatsApp conversation management, AI-powered chatbot tools, approved message templates, marketing campaigns, scheduling and automation, support ticketing, billing and subscriptions, APIs, webhooks, and third-party integrations. We may update, modify, suspend, or discontinue parts of the services at any time for product, legal, operational, or technical reasons. Customer Responsibilities You agree to: Use the services lawfully and responsibly Obtain all necessary consents, permissions, and notices before sending messages or processing third-party data Avoid using the platform for spam, fraud, harassment, or unlawful conduct Comply with Meta, WhatsApp, and all relevant third-party policies Ensure that the content and data used through the platform do not violate any law or third-party rights WhatsApp, Meta, and Third-Party Compliance If you use Bulq with WhatsApp, Meta, or any external platform, you are solely responsible for complying with their terms, policies, and technical requirements, including messaging rules, approved templates, consent requirements, message windows, business policies, and commerce rules. Bulq is not responsible for any restriction, suspension, limitation, rejection, or enforcement action taken by any third party against your accounts, numbers, pages, or business assets. Acceptable Use You may not: Use the services for any unlawful, harmful, deceptive, or fraudulent purpose Send unauthorized or unsolicited communications Upload malware, malicious code, or harmful material Attempt unauthorized access to systems, services, or data Interfere with or disrupt the performance or integrity of the platform Infringe the intellectual property, privacy, or other rights of others Subscriptions and Payments Some features of Bulq may require payment. By subscribing to a paid plan, you agree to pay all applicable fees, taxes, and charges according to your selected plan and billing cycle. Unless otherwise stated: Fees are charged in advance Subscriptions may renew automatically Payments are non-refundable except where required by law or expressly stated otherwise We may suspend or limit services for overdue accounts Trials and Promotions We may offer free trials or promotional offers from time to time. We reserve the right to change or terminate such offers at any time. Intellectual Property All rights, title, and interest in the platform, software, branding, design, documentation, and related materials belong to Bulq or its licensors. The customer retains ownership of its content and data, but grants Bulq a limited, non-exclusive right to host, process, store, and transmit such content only as necessary to provide, maintain, support, and improve the services. Privacy and Data Protection Our collection and use of data are governed by our Privacy Policy, which forms part of these Terms. By using the services, you acknowledge that you have read and understood the Privacy Policy. Availability and Support We aim to provide a reliable service, but we do not guarantee that the platform will always be uninterrupted, error-free, or available at all times. The services may be temporarily unavailable for maintenance, updates, or reasons beyond our control. Suspension and Termination We may suspend, restrict, or terminate your access to the services if you violate these Terms, misuse the platform, or where necessary for legal, security, or operational reasons. You may stop using the services and cancel your subscription in accordance with the cancellation methods made available through the platform or by contacting us. Limitation of Liability To the maximum extent permitted by law, Bulq shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or business interruption arising out of or related to your use of the services. In all cases, Bulq’s total aggregate liability shall not exceed the amount paid by you to Bulq during the last [3 or 6 or 12] months preceding the event giving rise to the claim.
